ASNE Memo on the Patriot Act II

In this article, several sections of the controversial Patriot Act II have been highlighted. Section 124 of the legislation allows that if law enforcement has reason to seize information for an investigation, they have access to all parts of that information regardless if it is for the case. For instance, if the police gains access to your email via your computer for a criminal case, any personal files on that computer can be seen and used by the police. This is a serious violation of one’s privacy, however it is also important to acknowledge that this degree of access can be exceptionally beneficial for law enforcement. An example would be if a Wall St banker’s computer was first confiscated for a crime, but was further analyzed to contain proof of embezzlement. In this scenario, Section 124 of the Patriot Act II would allow the police to pursue this banker on the account of his or her embezzling, ridding the community of one more criminal. It is clear that this part of the legislation violates the privacy of individuals, but does it or any other part of the law’s pros outweigh the cons?
